    Health supplement triples fertility, Israeli researchers find.
    An anti-aging drug, sold over the counter worldwide, has been found to dramatically improve pregnancy rates among women undergoing treatments for infertility, according to new Israeli research.

    This supplement could triple a women’s chance of getting pregnant, and help her carry the baby to term, according to a new report by Israeli researchers. Scientists from the Meir Medical Center and Tel Aviv University (TAU) found a statistical connection between the over-the-counter vitamin supplement, DHEA, and successful pregnancy rates in women undergoing treatment for infertility. In the US alone, some six million women a year suffer from infertility, according to the American Pregnancy Association.

    Spring is traditionally budget/appropriations season in Washington. With the President, all of the House of Representatives and one-third of the Senate running for re-election, every vote, every speech, and every committee action is politicized. This means that how it affects voters in November is part of the consideration the legislative leadership takes on what they move forward and what legislators do when they cast votes. There are and will continue to be grand announcements by federal agencies or about federal agencies (good and bad) that are tailored to encourage Congressional funding support.

    Energy Drinks the Latest Target to be used to Push S. 310. We need to Continue Opposing S. 1310 the Dietary Supplement Labeling Act of 2011:
    Senater Durbin continues his quest to restrict access to dietary supplements. He has targeted so-called energy drinks as a strategy through which he will move to have S. 310 approved. He recently sent a letter to the FDA asking that energy drinks which contain caffeine be regulated as drinks rather than dietary supplements so that caffeine limits may be set. Such a move will affect Solstic Energy and other powder mix dietary supplements that provide an alternative delivery system of consuming dietary supplement ingredients. Whether or not you are a fan of caffeine, picking ingredients and specific products or groups of products off one at a time provides a wedge through which Durbin (and Waxman) will drive changes to DSHEA and promote drug like premarket approval regulations.  Caffeine does have a stimulant property and when used, should be used wisely. Consuming too much caffeine in any form – coffee, tea, Monster, Red Bull, or green tea supplements can be over stimulating. We’ve already submitted thousands of letters, but we need to renew this opposition. Our message to Senators is simple – No new regulations on dietary supplements! Call both your Senators with this message.

    FDA NDI Activity: Since the docket closed in December on the FDA’s Draft Guidance document to Dietary Supplement Industry on New Dietary Ingredients, the agency has remained quiet about what it will do in response to the overwhelming opposition to the document as written. A letter sent in January from Senators Hatch and Harkin to the agency calling for a rewrite has not yet been responded to by the FDA. A direct request to the agency this week has also provided no new information.

    Nanotechnology: In June 2011, about the same time of this NDI Draft Guidance, the agency also issued a Draft Guidance on Nanotechnology. As part of that process, they have released for public comment Draft Guidance for Industry; Assessing the Effects of Significant Manufacturing Process Changes, Including Emerging Technologies. On the Safety and Regulatory Status of Food Ingredients and Food contact substances, Including Food Ingredients that are Color Additives. I am currently reviewing and will report back by the end of the week on how or/if these is something to worry about in this. They have also issued a Draft Guidance Document on Cosmetics and nanotechnology which may affect the natural products industry companies that sell cosmetics. I will report back on that as well.

    Dietary Supplement Senate Legend at Risk: The re-election of the dietary supplement community’s champion Senator Orrin Hatch of Utah is vulnerable. In 2011 there was talk that Congressman jason Chaffetz (also a supplement champion) would challenge Senator Hatch during the primary process. He declined to take on the Senate and in last Week’s caucus process in Utah received more than 50% of the votes so he does not face a primary challenger. Senator Hatch fell 32 votes short in the caucus process which requires a 50% dominance to avoid a primary challenger. He was not so fortunate, and only garnered 49% of the vote due to Tea Party move through the Freedomworks Super Pac to elect only conservative members. (Senator Hatch has long been known to reach across the aisle on major legislative actions.) Senator Hatch will face former State Senator Dan Liljenquist in the Republican primary. Why does this matter to CodeFund.com? Senator hatch’s seniority in the Senate is a vital counterbalance to Senator Richard Durbin who is in the Democratic Leadership of the Senate and who seeks major changes to dietary supplement regulations that will undermine the hard won victories of DSHEA and Proxmire.

    We Need to Build More Champions: As many know, long time health freedom champions Congressman Dan Burton and Congressman Ron Paul are not seeking re-election. Congressman Dennis Kucinich who has been a champion in particular on fighting genetically engineered food and on alternative medicine issues is also not returning to Congress in 2013. It is vitally important that each of us engage in a direct dialogue with our own legislators to make sure they know that protecting DSHAE (and Proxmire) are important. I am continuing my meetings with newer members of Congress to educate them on DSHEA and encourage they participate as defenders of health freedom.

    Testimonial Free Speech Bill Needs More Supporters: Congressman Ron Paul Introduced HR 2908 the Testimonial Free Speech Bill for our industry to protect consumer testimonials. This bill has not gotten the traction it needs to move forward. We need everyone to call their legislators an encourage support. Go to Codexfund.com website and print and fax in the letter of support. Get as many letters as you can so I can bundle and take with me to personal meetings. Why is this bill so important? Consumer Testimonials have long been a valuable marketing tool for every industry. The food and supplement industries are no different It is also the only industry in which the government is actively moving to suppress the free speech of consumers. FDA wrongly interprets the law to go after companies who share the testimonials of their customers. If a consumer writes in to a company or posts on a web site the benefits of certain products or foods, and happens in that testimonial to mention a disease, the FDA warns the company to take the statement down or risk having the product declared an ‘unapproved new drug’. Consumer testimonials are incredibly powerful and helpful tools for other consumers who want actually input on products which they are considering to buy.
